3. Disclaimer of liability
3.1 To the fullest extent not prohibited by law, Easy Business Websites disclaims any and all warranties, express or implied, regarding:
(a) the accuracy, reliability, timeliness or otherwise of any information contained or referred to on the Website and/or any Linked Websites; and
(b) the merchantability or fitness for any particular purpose, any service or product contained in, referred to or provided by the Website and/or any Linked Websites.
3.2 Easy Business Websites will not be liable under any circumstances for any loss of profits or any damages of any kind (even if it has been advised of the possibility of such loss of profits or damages) which are the consequence of you:

(c) errors and defects in the Website will be corrected.

(b) delays to, interruptions of or cessation of the services provided in the Website, or Linked Websites;
(c) the defamatory, offensive or illegal conduct of any user of the Website; and

4. Limitation of liability
4.1 To the fullest extent not prohibited by law Easy Business Websites’ liability for any implied warranty or condition is limited to, at the choice of Easy Business Websites, one or more of the following:
If the breach of an implied warranty or condition relates to services:
(a) the supply of the services again; or
(b) the payment of the cost of having the services supplied again.
If the breach of an implied warranty or condition relates to goods:
(a) the replacement of the goods or the supply of equivalent goods;
(b) the repair of such goods;
(c) the payment of the cost of replacing the goods or acquiring equivalent goods, or having the goods repaired.
5. Use of information gathered
5.1 Easy Business Websites and/or people authorised by it may gather and process the information:
(a) which you may provide when accessing the Website, such as your name, address, e-mail address and other personal information about you; and
(b) regarding the way in which you use the Website including, without limitation, information acquired through the use of “cookies” programmed during the accessing of the Website.
6. Termination of access
6.1 Easy Business Websites may terminate access to the Website at any time without giving any explanation or justification for the termination of access, and Easy Business Websites has no liability for any costs, losses or damages of any kind arising as a consequence of terminating access to the Website.

8. Relevant jurisdiction
8.1 These Terms of Access will be governed by and interpreted in accordance with the law of Queensland, Australia without giving effect to any principles of conflicts of laws.
8.3 You agree to the jurisdiction of the courts of Queensland, Australia to determine any dispute arising out of these Terms of Access.
9. Licence to use intellectual property
9.1 By uploading any material which is intellectual property including, but not limited to, copyrighted works, trade marks and service marks (the “intellectual property”) on to the Website, you are granting Easy Business Websites a perpetual, non-exclusive and payment-free licence throughout the world (and warranting that you are entitled to do so) to:
(a) reproduce, use and exploit the intellectual property, as part of the Website, to the full extent permitted by intellectual property law in any jurisdiction in which the Website is available to users; and
(b) allow Easy Business Websites to sub-licence others the same rights granted to Easy Business Websites in (a) above.
10. Removal of information
10.1 In relation to any content included on the Website, Easy Business Websites may remove any content, including but not limited to links to other websites on the internet, at any time without giving any explanation or justification for removing the content.
11. Indemnity
11.1 You will at all times indemnify and keep indemnified Easy Business Websites and its respective officers, employees and agents (referred to as “those indemnified”) from and against any loss (including reasonable legal costs and expenses) or liability incurred by any of those indemnified arising from any claim, demand, suit, action or proceeding by any person against any of those indemnified where such loss or liability arose out of, in connection with or in respect of any breach of these Terms of Access by you; and publication of or distribution of any content supplied by you.
12. Miscellaneous
12.1 These Terms of Access embody the entire agreement of the parties as to its subject matter and supersede and cancel all prior agreements, understandings and negotiations in connection with it. No oral explanation or information provided by any party to another affects the meaning or interpretation of this document or constitutes any collateral agreement, warranty or understanding between the parties.
12.2 If any part of these Terms of Access are found to be void, unlawful, or unenforceable, then that part will be deemed to be severable from the balance of these Terms of Access and the severed part will not affect the validity and enforceability of any remaining provisions.

3. You authorise us to charge the purchase of your domain name (where requested $88) and the monthly hosting fee of $29.50 per month to your credit card from today until you cancel the hosting of your website.
4. You shall provide and enter your own website content through our simple to use system.
5. You are solely responsible for the content of your website and warrant that you have the right to use and place that content on your website
6. That the content of your site does not infringe the rights of any third party, is not pornographic, defamatory or misleading.
7. That we will not be liable for any delays, loss of data or service outages however caused.
8. That you will indemnify us for any breach of these terms and conditions by you.
